General terms and conditions of sale of products sold on Ma Petite Corée

Article 1 - Purpose

These conditions govern sales by the company MPC TRADES / 엠피씨 트래이드 321-2 Itaewon-dong, Yongsan-gu, Seoul 04357 

Article 2 - Price

The prices of our products are indicated in euros, all taxes included (VAT and other taxes applicable on the day of the order), unless otherwise stated and excluding processing and shipping fees.

In case of an order to a country other than metropolitan France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These duties and amounts are not the responsibility of the company MPC TRADES / 엠피씨 트래이드. They will be your responsibility and are entirely your responsibility, both in terms of declarations and payments to the competent authorities and organizations of your country. We advise you to inquire about these aspects with your local authorities. All orders, regardless of their origin, are payable in euros.

The company MPC TRADES / 엠피씨 트래이드 reserves the right to change its prices at any time, but the product will be invoiced based on the price in effect at the time of order validation and subject to availability. The products remain the property of the company MPC TRADES / 엠피씨 트래이드 until full payment of the price. Warning: as soon as you physically take possession of the ordered products, the risks of loss or damage to the products are transferred to you.

Article 3 - Orders

The company MPC TRADES / 엠피씨 트래이드 reserves the right not to record a payment, and not to confirm an order for any reason whatsoever, particularly in case of supply problems, or in case of difficulty regarding the received order.

Article 4 - Validation of your order

Any order listed on the website https://mapetitecoree.com/ assume adherence to these General Conditions. Any order confirmation implies your full and complete acceptance of these general terms and conditions of sale, without exception or reservation. All provided data and the recorded confirmation will serve as proof of the transaction. You declare to have full knowledge of them. The order confirmation will be considered as signature and acceptance of the operations carried out. A summary of your order information and these General Conditions will be sent to you in PDF format via the order confirmation email address.

 

Article 5 - Payment

By validating your order, you commit to paying the indicated price. Payment for your purchases is made by credit card through the secure system. The card is only debited at the time of shipment of the order. In case of split deliveries, only the shipped products are debited.

 

Article 6 - Withdrawal

In accordance with the provisions of Article L.121-21 of the Consumer Code, returns must be made in their original and complete condition (packaging, accessories, manual). In this context, your responsibility is engaged. Any damage suffered by the product on this occasion may be sufficient to invalidate the right of withdrawal. Return costs are your responsibility. In case of exercise of the right of withdrawal, the company MPC TRADES / 엠피씨 트래이드 will refund the amounts paid within 14 days following the notification of your request and via the same payment method used during the order.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL In accordance with the provisions of Article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to: The provision of services fully performed before the end of the withdrawal period and whose execution began after the consumer's prior express agreement and express waiver of their right of withdrawal. The provision of goods or services whose price depends on fluctuations in the financial market beyond the professional's control and likely to occur during the withdrawal period. The provision of goods made according to the consumer's specifications or clearly personalized. The provision of goods liable to deteriorate or expire rapidly. The provision of goods that have been unsealed by the consumer after delivery and cannot be returned for reasons of hygiene or health protection. The provision of goods which, after delivery and by their nature, are inseparably mixed with other items; The provision of alcoholic beverages whose delivery is deferred beyond thirty days and whose agreed value at the conclusion of the contract depends on market fluctuations beyond the professional's control. The provision of audio or video recordings or computer software when they have been unsealed by the consumer after delivery. The provision of a newspaper, periodical, or magazine, except for subscription contracts to these publications. Transactions concluded at a public auction. The provision of digital content not supplied on a tangible medium whose execution began after the consumer's prior express agreement and express waiver of their right of withdrawal. Article 7- Availability

 Our products are offered as long as they are visible on the site https://mapetitecoree.com/ and within available stock limits. For non-stocked products, our offers are valid subject to availability from our suppliers. In case of product unavailability after placing your order, we will contact you as soon as possible to offer either: a replacement product, or a full refund of the unavailable product. Furthermore, the website https://mapetitecoree.com/ is not intended to sell its products in large quantities. Therefore, the company MPC TRADES / 엠피씨 트래이드 reserves the right to refuse orders of identical items.

Article 8 - Delivery

Products are delivered to the delivery address indicated during the ordering process, within the time frame indicated on the order confirmation page. 

The delivery times indicated on the order confirmation page correspond to the transport time after shipment and do not include preparation time. 

The average order preparation time is 2 to 4 business days. In case of a shipping delay exceeding 6 days, an email will be sent to inform you of a possible impact on the delivery time indicated to you.

The total delivery times (preparation and transport) are therefore 24 business days for K-Packet and 15 business days for DHL.

Delivery methods offered:

-K-Packet: transport up to 14 business days after shipment, without signature.

-DHL: transport up to 5 business days after shipment, with signature.

In case of exceeding the maximum legal period of 30 days (preparation + transport), we will contact the client to offer a full refund or obtain their agreement for a delayed shipment (with compensation if necessary).

In accordance with legal provisions, the company MPC TRADES / 엠피씨 트래이드 cannot be held responsible for delivery delays exclusively due to the client's unavailability after several appointment proposals.

When sending parcels, you will receive a confirmation email from our carrier as well as from MPC TRADES / 엠피씨 트래이드 indicating the tracking number and the possible delivery date. Please monitor this and contact our carrier directly if you wish to change the address or the delivery time.

In case of parcel return to our Seoul offices, no free reshipment will be made knowing that the delivery fees have already been paid. Your parcel will be reshipped after calculation and payment of additional fees to cover the losses of this first shipment.

In case of damaged products or delivery errors of a product, they will be refunded or reshipped. Note that this does not include packaging (box).

Delivery is not available to certain countries (e.g., Spain, Mexico) for customs reasons.
In case of delivery impossibility, the order will be canceled and fully refunded.

Please note that Ma Petite Corée is not responsible for any customs fees that may be applied by the local authorities of your country. 

Furthermore, shipments with DHL may be subject to random checks that can result in customs fees or delays. DHL may request proof of payment, which we will provide upon request. Additional delays or fees related to customs are not the responsibility of Ma Petite Corée.

💡 All customs fees are beyond our control and remain the responsibility of the buyer. No refund can be made in case of applied fees.  

Article 9 - Delivery issues

Package marked as delivered but not received
For K-Packet shipments, La Poste does not allow claims if the package is marked as delivered.
The customer must first contact La Poste to verify the location of the package. If La Poste cannot provide explanations regarding the location of the package, the customer must request a document certifying non-receipt, send it to us, as well as a sworn statement written by the customer accompanied by an identity document. Without these documents, no refund can be granted.

Damaged package
Any claim must be made by email with a photo of the damaged package and the unusable product is mandatory. 

Incorrect address
If the package is returned due to incorrect address:

Option 1: Refund of the item excluding shipping costs.

Option 2: Reshipment to a new address, shipping costs borne by the customer.

Article 10 - Warranty

All our products benefit from the legal warranty of conformity and the warranty against hidden defects, as provided by Articles 1641 and following of the Civil Code. In case of non-conformity of a sold product, it may be returned, exchanged, or refunded. All claims, exchange or refund requests must be made within 30 days of delivery.

Products must be returned to us in the condition in which you received them, with all components (accessories, packaging, instructions...). Shipping costs will be reimbursed based on the charged rate, and return costs will be reimbursed upon presentation of receipts. The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.

Article 11 - Liability

The responsibility of the company MPC TRADES / 엠피씨 트래이드 cannot be engaged in case of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities the possibilities of importing or using the products or services you intend to order.

Furthermore, the company MPC TRADES / 엠피씨 트래이드 cannot be held responsible for damages resulting from improper use of the purchased product. Finally, the responsibility of the company MPC TRADES / 엠피씨 트래이드 cannot be engaged for any inconveniences or damages inherent to the use of the Internet network, notably service interruptions, external intrusions, or the presence of computer viruses.

 

Article 12 - Applicable Law in Case of Disputes

The language of this contract is French. These terms of sale are subject to French law. In case of dispute, French courts shall have exclusive jurisdiction.

 

Article 13 - Intellectual Property

All elements of the site https://mapetitecoree.com/ are and remain the intellectual and exclusive property of the company MPC TRADES / 엠피씨 트래이드. No one is authorized to reproduce, exploit, redistribute, or use in any way, even partially, elements of the site whether software, visual, or sound. Any simple or hypertext link is strictly prohibited without the express written agreement of the company MPC TRADES / 엠피씨 트래이드. Article 13 - Personal Data The company MPC TRADES / 엠피씨 트래이드 reserves the right to collect nominative information and personal data concerning you. They are necessary for managing your order, as well as improving the services and information we send you. They may also be transmitted to companies contributing to these relations, such as those responsible for executing services and orders for their management, execution, processing, and payment. This information and data are also kept for security purposes, to comply with legal and regulatory obligations. In accordance with the law of January 6, 1978, you have the right to access, rectify, and oppose nominative information and personal data concerning you, directly on the website.

Article 14 - Archiving Evidence

The company MPC TRADES / 엠피씨 트래이드 will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code. The computerized records of the company MPC TRADES / 엠피씨 트래이드 will be considered by all concerned parties as proof of communications, orders, payments, and transactions between the parties.
